UIC-09-2024-0016: Bank of Hawaii as Trustee of the Kukuiolono Park Trust Estate; Consent Agreement and Proposed Final Order
Consent Agreement and Proposed Final Order (“Proposed Consent Agreement”), between the U.S. Environmental Protection Agency, Region 9 (“EPA”), and the Bank of Hawaii, as Trustee of the Kukuiolono Park Trust Estate, to resolve the following civil administrative proceeding under Sections 1423(c)(3)(B) of the Act.

Respondent: Bank of Hawaii, solely in its capacity as Trustee of the Kukuiolono Park Trust Estate, and not in its individual or corporate capacity
Facilities: The Kukuiolono Park and Golf Course Pavilion and Comfort Station and the Kukuiolono Camp (Tax Map Keys: 4-2-3-005-002 and 4-2-3-005-024), Kalaheo, Kauaʻi, Hawai'i.
Description of Business or Activity Conducted by the Respondent: The Kukuiolono Park Trust Estate is a private foundation whose purpose is the operation of the Kukuiolono Park and Golf Course for public use.
Alleged Violations: EPA alleges that Respondent owned and/or operated three (3) LCCs in violation of the ban that took effect on April 5, 2005. 40 C.F.R. § 144.88.
Proposed Order and Penalty: $58,000
