Updates to Confidential Status of Chemicals on the TSCA Inventory
The latest Toxic Substances Control Act (TSCA) Chemical Substance Inventory was made available on EPA’s website on Aug. 16, 2023. This update to the public TSCA Inventory included 579 chemicals listed with their specific chemical identities after having been moved from the confidential portion of the Inventory to the public portion as part of ongoing TSCA confidential business information (CBI) review plan efforts. Prior to the Aug. 2023 update to the TSCA Inventory, EPA moved 377 chemicals to the public portion of the Inventory in March 2022.
These specific chemical identities were identified as being no longer eligible for the confidential TSCA Inventory consistent with TSCA section 8(b) and as a result of the TSCA Inventory Notification (Active-Inactive) Requirements Rule reporting. Several of these chemicals were found to be no longer entitled to confidential treatment as a result of reviews performed under the CBI review plan rule promulgated under TSCA Section 8(b)(4)(C) on Feb. 19, 2020. As EPA continues to complete the review of confidentiality claims for specific chemical identity in Notice of Activity Form A (NAA) submissions, it is expected there will be many more chemicals whose specific chemical identity is no longer entitled to confidential treatment.
