  • Facilities on Indian lands in Idaho, Oregon and Washington.
  • Federal operators in Washington.
  • The Metlakatla Reservation and Denali National Park in Alaska.

How to Apply

  1. Read EPA's 2022 Construction General Permit.
  2. Develop a Stormwater Pollution Prevention Plan (SWPPP) for your construction site.
  3. Complete an endangered species determination for the project site (details are noted in the CGP).
  4. Get authorization from EPA if you plan to use chemical treatment (most projects do not - see special instructions for chemical treatment below).
  5. File a Notice Of Intent (NOI) using EPA's NPDES eReporting Tool (CGP-Net) (see common questions about eNOI below).
  6. Implement the Best Management Practices (BMPs) outlined in the SWPPP.

Common Questions about eNOI

  1. The EPA hasn’t certified my NOI yet. Why?
    1. The operator certifies the NOI, not EPA.
    2. Please go back into CDX and change the Certifier information to an appropriate person in the construction project’s chain of command.
  2. Did you get my eNOI / eNOT?
    1. If the certifier didn’t get an automatic EPA NeT CGP Forms Certified email (or EPA NeT CGP Forms Terminated) within 10-15 minutes of submission, the NOI/NOT has likely not been received by EPA’s CGP NeT system. Please double check the form for possible problems. If you cannot determine what is wrong, call the CGP NeT helpdesk at 866-352-7755 [8am-5pm (Eastern)] If it went through, the form’s status in CDX will change from “draft” to “under review.”
    2. If you are not the certifier and have flagged the form for certification via CGP-NeT, you may need to make sure that the certifier completes the form by certifying and submitting the NOI/NOT to ensure either the 14-day review period is initiated, or the NOI is terminated.
  3. The previous land owner got permit coverage and then defaulted on the loan/died/went to jail. Can I use that NOI?
    1. No. Coverage is not transferable.
  4. I requested permissions for a NOI and haven’t received a response. Why?
    1. CGP-NeT sends permission requests to the individual assigned “manage” permissions for the NOI. If the NOI’s assigned “manager” is no longer with the operator’s organization and you have submitted a permission request, please contact the EPA regional coordinator to process the request.
  5. How can I confirm whether this project has coverage?
    1. Permit records (i.e., copies of certified NOIs) and related submissions for general permits such as EPA’s CGP and Multi-Sector General Permit for Industrial Stormwater are publicly accessible via EPA’s permit lookup tool. In addition, compliance and enforcement data related to the permitted site or facility are publicly accessible via EPA’s Enforcement and Compliance History Online (ECHO) tool.

Idaho

The EPA CGP only applies to projects on tribal lands within Idaho. All other projects are within the State of Idaho’s permit program. To apply for storm water permits, go to Idaho DEQ’s E-Permitting system.
