Public Notice of Draft NPDES Permit

This is to give notice that the U.S. Environmental Protection Agency, Region 6, has received a Notice of Intent (NOI) for permit coverage under the National Pollutant Discharge Elimination System (NPDES) General Permit for Discharges from a Concentrated Animal Feeding Operation (CAFO) in New Mexico.

The following owner/operator is seeking coverage under EPA’s NPDES Program for the authorization to discharge to water of the United States. The General Permit for Discharges from CAFO’s in New Mexico is NMG010000.

The New Mexico CAFO General Permit became effective on September 1, 2016, and expires on August 31, 2021. The New Mexico CAFO General Permit and more information on the Region 6 NDPES CAFO Program can be found at: http://www.epa.gov/region6/water/npdes/cafo/index.htm.

The permit requires CAFO owners/operators seeking permit coverage to submit an NOI and Nutrient Management Plan (NMP) to EPA. The NOI, NMP, and draft terms of the NMP to be incorporated into the permit will be made available for a 30-day public review and comment period. These documents will be available upon request and public notices are located on EPA’s public notice webpage at:  https://www.epa.gov/publicnotices .

EPA's comments and public hearing procedures may be found at 40 CFR 124.10 and 124.12. The comment period during which written comments on the draft permit may be submitted extends for 30 days from the date of this Notice. During the comment period, any interested person may request a Public Hearing by filing a written request which must state the issues to be raised. A public hearing will be held when EPA finds a significant degree of public interest.

EPA will notify the owner/operator and each person who has submitted comments or requested notice of the final decision to grant or deny coverage under the general permit.
