Second Five-Year Review Completed
The U.S. Environmental Protection Agency (EPA) Region 7 has completed the Second Five-Year Review for the Garvey Elevator Superfund Site. Five-Year Reviews are required by the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), commonly known as Superfund, when hazardous substances remain on-site above levels that permit unrestricted use and unlimited exposure.
Five-Year Reviews provide an opportunity to evaluate the site remedy to determine whether it remains protective of human health and the environment.
This Five-Year Review found that the remedy at Operable Unit 1 (OU1) of the site currently protects human health and the environment in the short term because institutional controls have been implemented and no unacceptable exposures are occurring. To be protective in the long term, the institutional controls may need to be modified to be compliant with Nebraska Universal Covenant Act requirements. Cleanup standards also need to be assessed and established for protection from vapor intrusion in soil gas and groundwater in an appropriate decision document, if necessary, to ensure remedy protectiveness. This Five-Year Review Report was signed Aug. 16, 2024.
