KENTUCKY BARGE CLEANING COMPANY CHARGED IN CRIMINAL CASE
On Feb. 10, River Road Terminal Inc. (RRT), a barge cleaning company, of Louisville, Ky., was charged in U.S. District Court for the Western District of Kentucky in Louisville with one count of violating the Clean Water Act (CWA). The charges allege that from about April 1, 1993 to Nov. 3, 1995, RRT discharged water into the Ohio River without obtaining a wastewater discharge permit as required by the CWA. As a result, it is alleged that potassium, ammonium nitrate and urea from residues of salts, fertilizers, and grain contained in the barges were illegally discharged into the river. High concentrations of fertilizers in rivers can contribute to changes in aquatic plant and fish communities, including fish kills and algae blooms. The case was investigated by EPA’s Criminal Investigation Division, the FBI, the U.S. Coast Guard and the Kentucky Department for Environmental Protection.
