EPA issued a complaint against Micro Flo, LLC (a subsidiary of BASF Corp.) on Sept. 13 for violating the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) by selling or distributing several pesticides which may present an unreasonable risk to human health and the environment. The company allegedly offered for sale or distribution several pesticide end-use products and active ingredient pesticides in which the ingredients did not coincide with the formula registered with EPA under the FIFRA law. The complaint assessed a civil penalty of $3.7 million, largest ever under FIFRA, and included 673 counts. Another contention is that the company falsified the Notices of Arrival accompanying shipments of active ingredient pesticides. The EPA investigation took place at the company plant in Sparks, Ga. and its warehouse in Tifton, Ga. Microflo will have the opportunity to contest the complaint.
