NORTH DAKOTA COMPANY PLEADS GUILTY TO CLEAN WATER ACT AND RESOURCE AND CONSERVATION AND RECOVERY ACT VIOLATIONS

On March 24, Dakota Catalyst Products Inc., (DCP) of Williston, N.D. plead guilty in U.S. District Court for the District of North Dakota in Bismarck to violating both the Clean Water Act (CWA) and the Resource Conservation and Recovery Act (RCRA). DCP was primarily in the business of recycling waste catalysts from oil refineries. Between June 1996 and April 1997, DCP violated its RCRA permit by illegally storing drums and large bins of mislabeled hazardous wastes at its Bismarck facility. Additionally, employees illegally discharged wastewater contaminated with benzene, a carcinogen, into the publicly-owned wastewater treatment facility in Williston. When sentenced, DCP faces a maximum fine of up to $500,000 on the RCRA charge and a fine of up to $25,000 on the CWA charges. This case was investigated by EPA’s Criminal Investigation Division, the FBI, and the North Dakota Department of Health and the North Dakota Bureau of Criminal Investigation with the assistance of EPA’s National Enforcement Investigations Center.
