EPA ISSUES NATIONAL CAPACITY ASSESSMENT REPORT

EPA has released a draft report that shows there is sufficient national capacity to manage all hazardous wastes projected to be generated through 2013. "Draft National Capacity Assessment Report" is based on state capacity assurance plans (CAPS). CAPS are submitted to the Agency by states to fulfill section 104 (c) (9) requirement of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). The CAPS provide assurance of the availability of hazardous waste treatment or disposal capacity to manage the hazardous waste expected to be generated within the state for 20 years. States must assure capacity before they can enter into cooperative agreements or contracts with EPA to receive Superfund remedial action funds. EPA will utilize the draft assessment and other data that become available to evaluate whether the assurance requirement under CERCLA has been met. There will be a 60-day public comment period. Copies of the "Draft National Capacity Assessment Report" and/or the executive summary (EPA530-9346) can be obtained by mailing a request to the RCRA Docket Information Center, Office of Solid Waste (5305), U.S. EPA, 401 M St. S.W., Washington, D.C. 20460, or by calling the RCRA Hotline at 1-800- 424-9346. The report is also available in electronic format on the Internet System through the EPA Public Access Server at gopher.epa.gov.
