FIP for Oil and Natural Gas Sources on the Uintah and Ouray Indian Reservation
The EPA Administrator signed the final rule entitled, “Federal Implementation Plan for Managing Emissions from Oil and Natural Gas Sources on Indian Country Lands Within the Uintah and Ouray Indian Reservation in Utah (SAN 5872.1)” on November 8, 2022. This Federal Implementation Plan (FIP) controls emissions from new, modified, and existing oil and natural gas facilities on the Indian country lands within the Uintah & Ouray (U&O) Indian Reservation to address air quality in the Uinta Basin Ozone Nonattainment Area in northeast Utah. The emissions reductions expected under this rule, known as the U&O FIP, also support the streamlined approach to authorize new and modified minor oil and natural gas production sources on the portions of the Uinta Basin Ozone Nonattainment Area that are on Indian country lands within the U&O Reservation.

Compliance Reporting Under the FIP
Submit any documents required under the FIP as follows:
- (Preferred) Electronically to the EPA’s Compliance and Emissions Data Reporting Interface (CEDRI) at https://www.epa.gov/electronic-reporting-air-emissions/cedri. CEDRI can be accessed directly through the EPA’s Central Data Exchange (CDX) at https://cdx.epa.gov. First-time users will need to register with CDX and add CEDRI to the account once registered. There are guides and FAQ's available at https://www.epa.gov/electronic-reporting-air-emissions/cedri-job-aides (see page 3 of the results list under the Job Aides and Frequent Questions Heading for the registration guides). **UPDATE (July 9, 2024)**: U&O FIP-specific reporting options are now enabled in CEDRI. Once registered and logged in, select "Create a Report," then select "State/Local/Tribe Rule or Permit," then under the "Parts" box, select "Part 49 - Indian Country: Air Quality Planning and Management." Click the "Search for Reports" button and then click on the "Add" button for the report you are submitting to CEDRI. The new reporting options contain the regulatory citation and description for each report required under the FIP. If an appropriate reporting option is not available, click on the "Add" button for "Other Documents." The report will be displayed below the list of reports. Click on "Next: Upload Documents" and follow the remaining steps to submit the report.

Triennial Emissions Reporting Under the FIP
Per 40 CFR 49.172, the FIP requires that each affected oil and natural gas source report an emissions inventory every three years, beginning with calendar year 2023. The inventory is due on April 15th of the year following each inventory year. The first report for calendar year 2023 emissions is due April 15, 2024. Reporting will be done via the Combined Air Emissions Reporting System (CAERS). Reporters must have an active account in the EPA’s Central Data Exchange (CDX) to report in CAERS.
The EPA held general Microsoft Teams-based CAERS trainings in January 2024 that were recorded and the recordings will be posted on the Combined Air Emissions Reporting System (CAERS) website. The EPA held CAERS trainings in February 2024 specific to triennial emissions inventory reporting under the FIP. The virtual trainings were recorded and the recordings were posted on the CAERS website.
**UPDATE (May 6, 2024)**: Based on feedback received at the February 26th emissions inventory reporting training, the EPA has restructured the reporting process for the calendar year 2023 emissions inventory reporting period.
The EPA Requests that each U&O FIP-affected oil and natural gas source operator complete the EPA workbook included below for all of your U&O FIP-affected facilities. This workbook is consistent with the workbook used by the Utah Department of Environmental Quality, with an additional data field for Source Classification Codes (SCCs), which are required by the EPA. To incorporate appropriate SCC information for your facilities, in every workbook tab please select the best applicable SCC from the drop down menu in addition to entering the other emissions data you are used to providing. Complete workbooks should be submitted to the EPA no later than July 30, 2024, through CEDRI using the same procedure described above for compliance reporting. **UPDATE (July 9, 2024)**: When adding the report type, click on the "Add" button for "49.4172 U&O FIP Triennial Emissions Inventory."
