Read Me: Arkansas SIP Regulations Effective November 15, 2000
Final approval of Arkansas Regulations 19 and 26 into the Arkansas SIP was published in the Federal Register on October 16, 2000 (64 FR 61103 to 61109) effective November 15, 2000.
Regulation 19, as adopted by the Arkansas Commission on Pollution Control and Ecology (ACPCE) on January 22, 1999, replaced the following regulations in the Arkansas SIP:
* Regulations of the Arkansas Plan of Implementation for Air Pollution Control
* Prevention of Significant Deterioration Supplement to the Arkansas Plan of Implementation for Air Pollution Control
* Regulations for the Control of Volatile Organic compounds;
Regulation 19 does not replace Arkansas Regulation 9, Regulations for Development and Implementation of a Permit Fee System for Environmental Permits Issued, in the Arkansas SIP. Regulation 9, as approved by EPA November 12, 1986 (51 FR 40975), at 52.170(c)(24) effective January 12, 1987, remains in the SIP. See Arkansas Regulation No. 9 above for the text of Regulation 9 approved by EPA November 12, 1986.
The EPA did not act upon Regulation 19, Chapter 8, 111(d) Designated Facilities, as adopted by ACPCE January 22, 1999, in the October 16, 2000, Federal Register action. Chapter 8 is a revision to the federally approved Arkansas 111(d) Plan which, technically, is not part of the Arkansas SIP. See the record above entitled "AR §19.08 111(d) Designated Facilities (as adopted by ACPCE on July 24, 1992, and revised by ADPCE on May 30, 1997)" for the current federally approved equivalent to Chapter 8. There is no regulatory change between the federally approved §19.08 and Chapter 8 adopted by the ACPCE on January 22, 1999.
