Response to Four Petitions for Reconsideration
EPA is partially denying four petitions for reconsideration and associated requests for administrative stay of the Federal "Good Neighbor Plan" for the 2015 Ozone National Ambient Air Quality Standards. After reviewing issues raised by these four petitions pertaining to preliminary judicial stays of a separate “state implementation plan disapproval” as to several states, EPA found they provide no basis on which the Good Neighbor Plan should be modified or withdrawn. At this time, the Agency is not addressing other arguments for reconsideration of the Good Neighbor Plan that have been filed by these or any other petitioners. EPA has sent a letter to each petitioner including a detailed enclosure outlining the rationale for our partial denial. The Agency is also signing a notice for publication in the Federal Register that we have taken this action.
